SUMMARY:
Approval of Master Agreement MA-299-12011560 with Natures Image, Inc. in an amount not to exceed $1,500,000 for a three-year period to provide native plant habitat management and maintenance services will support continued landfill operations and compliance with Federal and State regulatory requirements at Central Region Landfills.
BACKGROUND INFORMATION:
OC Waste & Recycling is responsible for managing the County’s solid waste disposal system including Central Region landfills, which consist of the active Frank R. Bowerman (FRB) Landfill and five closed solid waste disposal sites. The FRB Landfill was opened in 1990 to meet the solid waste disposal needs of the central portion of Orange County.
Native plant habitat management and maintenance services are required to facilitate the FRB Landfill master plan development and support compliance with regulatory requirements. Resource Agencies with regulatory requirements that must be satisfied include the Natural Community Conservation Plan; US Fish and Wildlife Services; California Department of Fish and Game; US Army Corps of Engineers; and Regional Water Quality Control Board. Construction permits issued by the Resource Agencies require mitigation for native plant habitat to be removed during the landfill phased development. Mitigation sites such as oak woodland and riparian scrub are to be created and maintained. These mitigation sites must reach their regulatory compliance goals for growth and coverage and/or they must continue to be maintained for several years. Failure to comply with regulatory requirements may preclude future permitting and limit future development of the FRB Landfill.
On August 10, 2011, OC Waste & Recycling issued a Request for Proposals for native plant habitat management and maintenance services at Central Region landfills. On January 10, 2012, your Board selected Natures Image, Inc. as the primary contractor to provide native plant habitat management and maintenance services and authorized OC Waste & Recycling to negotiate an agreement for your Board’s approval. A copy of the recommended Master Agreement MA-299-12011560 is on file with the Clerk of the Board.
The scope of work in the recommended Agreement includes, but is not limited to, monitoring and maintaining mitigation sites; providing weed and pest control at the FRB Landfill mitigation sites; perform weeding at two off-site mitigation sites; hydroseeding on an as-needed basis; and maintaining irrigation systems at the FRB and Santiago Canyon landfills. The mitigation sites at the FRB Landfill include the existing South-West Desilting Basin and West Channel; and the future East Flank Landslide and Phase VIII-C.
As new phases are developed at the FRB Landfill, additional mitigation sites will be added as required by the Resource Agencies. Existing mitigation sites will be certified as they mature and meet regulatory compliance goals. Natures Image, Inc. will develop, implement, and monitor the management and maintenance plan for mitigation sites at the FRB and Santiago Canyon landfills. Natures Image, Inc. will also salvage sensitive plant species from the steep canyon slopes prior to the start of grading activities. To guarantee the success of mitigation sites, an adaptive management approach will be used, which is a measured response to maintaining a site after monitoring the site conditions.
CEQA Compliance: Pursuant to California Environmental Quality Act (CEQA) Section 21065 and CEQA Guidelines Section 15378, the recommended action is not a project as defined by CEQA. This is because the subject Agreement will not cause either a direct physical change in the environment, or a foreseeable indirect physical change in the environment.
