RECOMMENDED ACTION(S):

 

Authorize the County Procurement Officer or Deputized designee to execute Amendment Number Two to the Leivas, Inc. dba Leivas Lighting contract for Facility Lighting Maintenance to increase the amount of the current term by $100,000, effective upon Board of Supervisors approval through May 9, 2025, and to renew for a one-year term effective May 10, 2025, through May 9, 2026, in an amount not to exceed $300,000, for a new cumulative amount of $1,140,000.

 

 

 

 

SUMMARY:

 

Approval of Amendment Number Two to the Leivas, Inc. dba Leivas Lighting contract will allow the Sheriff-Coroner Department to increase the contract amount of the current term and to renew for an additional one-year term for facility lighting maintenance and safe operation of facilities throughout Orange County.

 

 

BACKGROUND INFORMATION:

 

The Sheriff-Coroner Department (Sheriff) has locations throughout greater Orange County, CA. requiring routine lighting inspection, testing, cleaning, maintenance, repairs, installations, LED lighting and minor alterations. These services include replacing interior and exterior, lamps, bulbs, tubes, diodes, fixtures, ballast, drivers, wiring, battery back-ups, diffusers, hardware and controls (including timers, photocells and clocks). Additionally, inspection, cleaning, testing, replacement, adjustments, preventative maintenance and corrective maintenance are also needed.

 

On January 27, 2021, Sheriff issued a competitive bid solicitation for facility lighting maintenance. On March 17, 2021, Sheriff received two responses. Leivas, Inc. dba Leivas Lighting (Leivas), was the lowest, most responsive, responsible bidder.

Sheriff requests Board approval of Amendment Number Two to the Leivas contract to increase the current contract term by $100,000, effective upon Board approval through May 9, 2025, and to renew the contract for the term of May 10, 2025, to May 9, 2026, in the not to exceed amount of $300,000, for a new cumulative total of $1,140,000, as noted in the Recommended Action. The increase to the current term and the renewal is due to Assembly Bill No. 2208 (Attachment C), which bans the sale of most fluorescent light bulbs, specifically pin-base and linear types, effective January 1, 2025. This significantly impacts Sheriff's current contract, as most Sheriff's facilities still use fluorescent lighting. This law, aimed at reducing mercury contamination, necessitates a shift to using light bulbs with Light Emitting Diodes, leading to an increase in costs, additional labor for retrofitting and potential system renovation.

 

This renewal amendment is going to the Board for approval less than 30 days prior to the start date due to delays in having to obtain the required signature titles. Contract is in its last renewal term. Prior to contract expiration, Sheriff will issue a solicitation to continue services.

 

Contractor's performance has been satisfactory. Sheriff has verified that there are no concerns that must be addressed with respect to contractor's ownership/name, litigation status or conflicts with County interests. Sheriff has conducted a due diligence check required by the revised 2024 Contract Policy Manual. This contract does not currently include subcontractors or pass through to other providers. See Attachment B for Contract Summary Form. The Orange County Preference Policy is not applicable to this contract renewal.

 

 

Compliance with CEQA:  This action is not a project within the meaning of the California Environmental Quality Act (CEQA) Guidelines Section 15378 and is therefore not subject to CEQA, since it does not have the potential for resulting in either a direct or physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.  The proposed contract provides for maintenance, repairs and emergency services of existing detention locks, sliders, doors and hardware within existing Sheriff’s jail facilities.  This proposed activity is therefore not subject to CEQA. Any future action connected to this approval that constitutes a project will be reviewed for compliance with CEQA.

 

 

 

FINANCIAL IMPACT:

 

Appropriations for this contract are included in Budget Control 060, Sheriff-Coroner's FY 2024-25 Budget, and will be included in the budgeting process in future years. The contract contains language allowing the Sheriff-Coroner Department to terminate the contract without penalty with cause or after 30 days of written notice without cause in the event that funding is reduced and/or not available to continue funding the contract.
