RECOMMENDED ACTION(S):

 

 

Approve and authorize the Registrar of Voters or designee to execute various renewals of leases and licenses of real property for ballot drop box locations for terms not to exceed five years, at no cost to the County, in substantially the form attached with minor modifications under certain conditions.

 

 

 

 

SUMMARY:

 

Authorizing the Registrar of Voters or designee to execute renewals of certain acquisition leases and licenses of real property for ballot drop box locations will allow the Registrar of Voters to secure the use of locations needed for the provision of State-mandated election-related activities.

 

 

 

 

BACKGROUND INFORMATION:

 

The County held its first Voter’s Choice Act election in March 2020.  For that election, multiple polling places were replaced by neighborhood Vote Centers, which were carefully selected facilities that are highly accessible and open for four to 10 days prior to election day.  Each registered voter received a vote-by-mail ballot automatically and had the option to return their ballot via secured ballot drop boxes located throughout the county, the minimum number of which is prescribed by California Elections Code Section 4005.  To comply with this requirement, the Registrar of Voters, in collaboration with the Chief Real Estate Officer, executed 188 Vote Center licenses and 98 ballot drop box licenses.  Additionally, the Registrar of Voters provided informational workshops, sessions and training on the Vote Center voting in facilities that necessitated the execution of similar licenses.

 

On July 14, 2020, the Board of Supervisors (Board) granted delegated authority to the Registrar of Voters pursuant to Government Code Section 25350.51 to negotiate and execute small leases and licenses to acquire rights to use real property for election purposes for terms not to exceed five years.  These licenses for ballot drop boxes have been granted at no cost to the County. 

 

The following agreements were previously contracted for five-year terms under this delegated authority, so Board approval is now necessary to extend or renew their terms.  Authorization by the Board to execute agreements in substantially the same form as the attached Model License with minor modifications that do not materially increase County costs or liability, subject to review and approval by County Counsel and CEO-Risk Management, will allow the Registrar of Voters to continue providing the same service locations for ballot drop boxes that voters have become accustomed to using.

Compliance with CEQA: This action is not a project within the meaning of CEQA Guidelines Section 15378 and is therefore not subject to CEQA, since it does not have the potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.  The approval of this agenda item does not commit the County or District to a definite course of action in regard to a project since the action authorized herein is a fill dirt license and a lease agreement.  This proposed activity is therefore not subject to CEQA.  Any future action connected to this approval that constitutes a project will be reviewed for compliance with CEQA.
