RECOMMENDED ACTION(S):

 

 

1.

Award Aggregate Job Order Contracts for Pavement Maintenance and Repair Services at John Wayne Airport to All American Asphalt and Sully-Miller Contracting Company, effective May 25, 2026, if executed with all necessary signatures by this date, or effective upon execution of all necessary signatures if executed after May 25, 2026. The contracts shall be effective for a term of one year from the date of commencement, with a combined Aggregate Contract Amount not to exceed $5,000,000.

 

2.

Authorize the County Procurement Officer or Deputized designee to execute the Aggregate Job Order Contracts. 

 

3.

Adopt the January 2026 Job Order Contract Unit Price Book - Construction Task Catalog and Technical Specifications prepared by The Gordian Group, Inc., which are on file with the Clerk of the Board.

 

 

 


 

 

SUMMARY:

 

Award of the Aggregate Job Order Contracts for Pavement Maintenance and Repair Services at John Wayne Airport will expedite the completion of pavement repair, rehabilitation and maintenance projects as needed, improve public safety, and reduce the potential adverse operational and financial impacts at the airport.

 

 

BACKGROUND INFORMATION:

 

On June 29, 2010, the Board of Supervisors (Board) approved the establishment of a Job Order Contract (JOC) program to expedite the completion of repair and rehabilitation projects involving existing County of Orange (County) facilities and structures. The JOC program includes a competitive public works bidding process. Contractors bid on a price adjustment factor that is multiplied by pre-determined unit prices for materials, equipment, and labor.

 

The purpose of the JOC program is to expedite services for maintenance and repair work involving health, safety, and mandated projects. These efforts include major and minor repairs and replacements. The JOC program is not used for new construction, including design or development of contract drawings, pursuant to Public Contract Code Section 20128.5.

 

To ensure the safety of passengers at John Wayne Airport (JWA), regular pavement maintenance of runways, taxiways, aprons, and vehicle service roads are performed using the JOC program. In order to meet JWA's obligation as federal grant fund recipients, the JOC program will allow JWA the ability to effectively and safely rehabilitate pavement at the airport, thus enhancing safety and prolonging the lifetime of the pavement.

 

The current JOC program for Pavement Maintenance and Repair Services (Services) at JWA was approved by the Board on May 6, 2025, and will expire on May 24, 2026. In an effort to maintain Services, a new JOC program is necessary.

 

On February 20, 2026, the Airport Director approved bid documents for use with the JOC program for Services and authorized the advertisement for bids. The bid documents were advertised in several industry publications and on the County’s online bidding system. Contractors were required to submit a pre-qualification questionnaire and pre-qualify to submit a proposal for Services. Two bids were received and deemed responsive. The Bid Summary is included as Attachment C.

 

JWA is recommending Board award of the JOCs for Services, effective May 25, 2026, or effective upon the date of execution of all necessary signatures if executed after May 25, 2026, for a term of one year. The combined aggregate amount for the two contracts will not exceed $5 million over the one-year term.

 

The contract capacity is based on planned projects as well as unplanned and/or emergency projects/work. See Attachment F for the JOC Services Work Exhibit. Planned projects are developed from JWA’s pavement management program in addition to coordination with other maintenance needs estimated to be approximately $3.6 million. The remaining contract capacity is reserved for unplanned projects and/or emergency repairs. Planned projects estimated to be $1 million or greater in value are as follows:

          - Gate Ramp Concrete Panel Replacement (estimated to be $1 million)

          - Taxiway A Concrete Panel Replacement (estimated to be $1.5 million)

* Note: An additional $1.4 million was planned to be executed through the FY 2025-26 JOC to address emergency runway repairs.  However, given that there was a Contractor for another on-going project within the area at that time (i.e. Taxiways A, D, E Reconstruction Project), JWA was able to more expediently and efficiently complete the remedial repairs utilizing their workforce, while also saving the County/JWA approximately $241,000 from the overall final cost when compared to JOC due to the benefit of the Contractor already being on-site.

 

Both Contractors’ license number was verified as current and active through the California Contractors State License Board database on March 3, 2026, and a copy of the verification is on file. Both Contractors are based in Orange County.

 

JWA has conducted due diligence of the consultants. Reference checks were satisfactory and completed with the following entities regarding similar Services:

This contract, due to the nature of the Services, could require the addition of subcontractors. In order to add a subcontractor(s) to the contract, the Contractor must seek express consent from JWA. Should the addition of a subcontractor(s) affect the scope of work and/or contract amount, JWA will bring the item back to the Board for approval. See Attachment C for the Contract Summary Forms.

 

JWA is procuring these Services in accordance with the 2024 Contract Policy Manual (CPM), Section 3.5-114. The Orange County Preference Policy is not applicable to the award of JOCs.

 

Furthermore, an analysis was completed to verify the contracts provide the County with persons specially trained, experienced, expert, and competent to perform special services in accordance with the law.

 

Compliance with CEQA: This action is not a project within the meaning of the California Environmental Quality Act (CEQA) Guidelines Section 15378 and is therefore not subject to CEQA, since it does not have the potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.  The approval of this agenda item does not commit the County to a definite course of action in regard to a project since it approves a contract for on-call pavement maintenance and repair services without approving any specific job/task order, location, or scope of work. This proposed activity is therefore not subject to CEQA. Any individual, specific work authorized pursuant to this contract will be reviewed for compliance with CEQA.

 

FINANCIAL IMPACT:

 

Appropriations for the contracts are included in JWA Operating Fund 280 FY 2025-26 Budget and will be included in the budgeting process for future years.

 

The proposed Contract includes provisions stating the Contract is subject to, and contingent upon, applicable budgetary appropriations being approved by the Board for each fiscal year during the term of the Contract. If such appropriations are not approved, or are reduced, the Contract may be immediately modified or terminated without penalty to the County. The proposed Contracts included a provision stating the Contract may be terminated for convenience of the County upon less than seven days written notice to the Contractor and upon 10 days written notice to the Contractor prior to the effective date of the termination without penalty to the County.
