RECOMMENDED ACTION(S):

 

Acting as the Orange County Board of Supervisors and the Governing Body of the Orange County In-Home Supportive Services Public Authority:

 

Approve Memorandum of Understanding with Orange County In-Home Supportive Services Public Authority for the Administration of In-Home Supportive Services, for the term of July 1, 2026, through June 30, 2029.

 

 

 

 

SUMMARY:

 

Approval of the Memorandum of Understanding will enable the County to continue to provide supportive services to persons who are aged, blind, or disabled, and who are limited in their ability to care for themselves and cannot live at home safely without assistance.

 


 

 

BACKGROUND INFORMATION:

 

The IHSS program provides supportive services to persons who are aged, blind, or disabled, and who are limited in their ability to care for themselves and cannot live at home safely without assistance. This includes persons who would be able to return to their homes from hospitals, nursing homes, or board and care homes, if they had help at home.

 

The proposed MOU remains consistent with the responsibilities for the administration, implementation, and operation of the Public Authority for IHSS providers. The Public Authority, which is the employer of record for collective bargaining purposes only, operates a “Homecare Registry” under which qualified IHSS providers are trained and referred to recipients to provide in-home services, e.g., non-medical personal care, paramedical tasks, or protective supervision.

On February 5, 2002, the Board of Supervisors (Board) adopted Ordinance No. 02-001, establishing the Public Authority and granting the Public Authority the powers necessary and appropriate to carry out the functions mandated pursuant to Welfare and Institutions Code (WIC) Section 12302.25.  See Attachment B for Ordinance No. 02-001.

 

The Board previously approved the Memorandum of Understanding (MOU) with the Orange County In-Home Supportive Services (IHSS) Public Authority for the Administration of IHSS as follows:

This MOU is authorized by the California Department of Social Services Purchase of Service Regulation, which states that contracts may be negotiated without formal advertising when the service is rendered by any local government agency. See Attachment C for Cited Codes, Regulations and Statutes. The Public Authority is governed by the Board and qualifies as a local governmental agency. See Attachment D for County of Orange Investment Policy.

 

SSA now requests the Board’s approval of this MOU with IHSS Public Authority for the Administration of IHSS.

 

This MOU does not currently include subcontractors or pass through other providers. See Attachment E for Contract Summary Form.

 

This MOU includes non-standard insurance provisions. See Attachment F for detailed information on risk assessments of insurance terms.
