RECOMMENDED ACTION(S):

 

 

1.

Adopt the Designation of Applicant’s Agent Resolution for Non-State Agencies from the State of California Governor’s Office of Emergency Services designating the OC Public Works Deputy Director of OC Operations and Maintenance, the OC Public Works Manager of OC Operations and Maintenance or the OC Public Works Emergency Coordinator of OC Operations and Maintenance for the purpose of obtaining certain federal financial assistance under Public Law 93-288 as amended by the Robert T. Stafford Disaster Relief and Emergency Assistance Act of 1988 and/or state financial assistance under the California Disaster Assistance Act.

Authorize Director of OC Public Works to designate County of Orange employees as Authorized Agents by Titles Only, via a cover letter naming the Authorized Agents by name and title, when completing the State of California Governor's Office of Emergency Services Form 130.

 


 

 

SUMMARY:

 

Approval of a revision to the Designation of Applicant’s Agent Resolution for Non-State Agencies and authorization for the Director of OC Public Works to designate County of Orange employees as Authorized Agents by Titles Only when completing the California Governor’s Office of Emergency Services Form 130 will allow OC Public Works to continue to obtain state and federal disaster reimbursements for all County of Orange departments and agencies as well as the Orange County Flood Control District.

 

 

 

BACKGROUND INFORMATION:

 

The Robert T. Stafford Disaster Relief and Emergency Assistance Act (Act) is the 1988 amended version of the Disaster Relief Act of 1974. It created the system in place today by which a presidential disaster declaration or an emergency declaration triggers financial and physical assistance through the Federal Emergency Management Agency (FEMA). The Act gives FEMA the responsibility for coordinating government-wide relief efforts, including monetary reimbursement for qualified relief work. The State of California Governor’s Office of Emergency Services (Cal OES) coordinates all monetary reimbursements for local municipalities. In order to streamline processes, Cal OES and FEMA require a designated Applicant Agent (Agent) to file applications on behalf of a local tribe, city, county or approved non-profit for the purpose of obtaining certain state and federal financial assistance under the Act.

 

Every three years, Cal OES requires the designation to be renewed or updated and certified by the governing body. The OC Public Works Emergency Coordinator is the primary Agent for the County of Orange (County). Although the County has modified its Agent several times due to staff position changes or agency reorganizations, OC Public Works has held the Agent duties since the 1990s. Prior Board of Supervisors (Board) actions regarding approval of resolutions relating to Cal OES Universal Form 130 (Form) are summarized in the table below.

OC Public Works is requesting the Board adopt the Designation of Applicant’s Agent Resolution for Non-State Agencies required by Cal OES regarding the Form, designating the titles of the individuals authorized to execute and file applications to obtain state and federal disaster reimbursements for all County departments and agencies as well as the District. Authorization is also being requested for the Director of OC Public Works to designate County employees as Agents by Title Only, via a cover letter naming the authorized agents by name and title, when completing the form.

 

COMPLIANCE WITH CEQA: This action is not a project within the meaning of CEQA Guidelines Section 15378 and is therefore not subject to CEQA, since it does not have the potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. The approval of this agenda item does not commit the County to a definite course of action regarding a project since it is an administrative action for the approval of a revision to the Designation of Applicant’s Agent Resolution to designate County employees as Authorized Agents on the California Governor’s Office of Emergency Services Form 130. This proposed activity is therefore not subject to CEQA. Any future action connected to this approval that constitutes a project will be reviewed for compliance with CEQA.
