establishes that the proposed subcontractor is qualified to perform services
under the Contract, the addition of a subcontractor does not affect the
overall scope of work, performance goals and the addition of the
subcontractor does not increase the Contract’s not to exceed amount. |
SUMMARY:
Approval of the new subcontractors
will enhance Community SeniorServ, Inc. dba Meals on Wheels Orange County’s
ability to fulfill Contract performance expectations for the Elderly Nutrition
Program and Supportive Services In-Home Program.
BACKGROUND
INFORMATION:
The California Department of Aging (CDA)
provides funding to OC Community Resources/Office on Aging (OCCR/OoA) for Older
Americans Act (Title III) programs and services. The Title IIIC Elderly
Nutrition Program (ENP) offers Congregate Meals and Home-Delivered Meals
Programs to older adults. Title IIIB enables older adults to access services
that address functional limitations, promote socialization and continued health
and independence. Under Title IIIB, a service offered through OCCR/OoA
contractors is In-Home Services.
On May 20, 2025, the Board of Supervisors
(Board) approved renewals for Contract MA-012-24011120 (ENP Contract) and
Supportive Services Contract MA-012-24011309 (SS Contract) with Community
SeniorServ, Inc., dba Meals on Wheels Orange County (Contractor) for services
effective July 1, 2025, through June 30, 2026.
The current approved subcontractors under
the ENP Contract (Attachment A) include Mangal Restaurant, Garlic and Chives,
and EveryTable. To-Go Meals and Restaurant Option Meal programs are optional
service models within ENP and were first included in the ENP Contract for FY
2024-25. These programs are supported by Modernizing Older Californian Act
funds and are available through March 31, 2029. The role of the restaurants is
to make and provide meals that have been approved by a registered dietician
assigned to OCCR/OoA and conduct required restaurant staff training. Adding
additional restaurants, Sandeulhae Inc and Jacinto & Corona Enterprises,
Inc. dba Don Jacinto Pollo Grill, to the ENP Contract will allow the Contractor
to expand culturally appropriate dining choices for the ENP participants.
The current In-Home Services
subcontractors for the SS Contract (Attachment B) include Care Partners and
Home Instead. Under the SS Contract, In-Home Services include personal care,
homemaker and chore activities. These two subcontractors have limited capacity
to offer chore services, therefore the Contractor has a need to secure an
additional subcontractor to provide the chore activities. The In-Home Services
subcontractor, Mother Earth Maids, LLC, will be tasked with providing both
homemaker and chore activities, which include heavy household tasks and yard
work.
All program participant eligibility, case
file management of program participants, and ensuring compliance with Title III
requirements of the ENP and SS Contracts will remain the direct responsibility
of the Contractor.
Per Contract Policy Manual 3.3-130,
OCCR/OoA requests Board approval to add subcontractors, Sandeulhae Inc and Don
Jacinto Pollo Grill, under the ENP Contract and Mother Earth Maids, LLC under
the SS Contract. See Attachment C for the Contract Summary Forms. The
appropriate due diligence has been conducted, and the proposed subcontractors
have been reviewed by OCCR/OoA and the County Procurement Office. The addition
of subcontractors to these Contracts would not affect the overall scope of
work, performance and/or contract amount.
OCCR/OoA also requests delegated authority
for the County Procurement Officer or a Deputized designee to review and
approve future subcontractor requests pursuant to section 3.3-130 of the
Contract Policy Manual, provided the County Procurement Officer or Deputized
designee performs the required due diligence and establishes that the proposed
subcontractor is qualified to perform services under the Contract, and the
addition of a subcontractor does not affect the overall scope of work or
increase the Contract’s not to exceed amount. Under the terms of the Contract,
any request to add subcontractor(s) must receive prior written approval from
the County Procurement Officer or deputized designee. If a request to approve a
subcontractor would affect the overall scope of work and/or Contract amount, in
excess of the Contract’s not to exceed amount, or otherwise fall outside the
scope of the authority granted, OCCR/OoA will bring the item back to the Board
for approval.
