RECOMMENDED ACTION(S):

 

 

1.

Authorize the County Procurement Officer or Deputized designee to execute Amendment One to Contract with New Alternatives, Inc. for Wraparound Orange County Direct Services to renew and amend the Contract in an amount not to exceed $7,100,000 effective July 1, 2026, to June 30, 2028, for a revised cumulative total amount not to exceed $17,750,000, effective July 1, 2023, through June 30, 2028.

SUMMARY:

 

Approval of the Amendments of the Wraparound Orange County Direct and Support Services Contracts will provide intensive, coordinated, and highly individualized services to eligible minors and non-minor dependents who are placed or at risk of being placed in residential treatment homes or juvenile correctional facilities.

 

 

BACKGROUND INFORMATION:

 

Per California mandate, Wraparound (Wrap) Orange County (OC) provides intensive, coordinated, and highly individualized community-based intervention services to eligible minors and non-minor dependents (NMDs) with complex mental health, behavioral and/or emotional needs who are wards, dependents, at risk of dependency, and/or exhibit significant underlying mental health issues who are placed or at risk of being placed in residential treatment or juvenile correctional facilities. SSA administers Wrap OC in partnership with the Orange County Health Care Agency (HCA) and the Orange County Probation Department (Probation). Wrap OC includes Direct and Support Services. The Direct Services contractors serve as coaches/case managers and provide interventions that build on the strengths of the minor, NMD, and family, including facilitating parent participation. The Support Services contractor supports the Direct Services Contractors by recruiting and training parent partners for the participants’ parent(s)/caregiver(s), fostering relationships with community businesses to obtain donated goods and services, developing and maintaining a database of available resources within the County and surrounding communities, conducting satisfaction surveys, and compiling data for SSA.

 

The Board of Supervisors (Board) previously approved the following Contracts for Wrap OC Direct Services with New Alternatives, Inc., Olive Crest, and South Coast Children’s Society, Inc., dba South Coast Community Services, and a Contract for Wrap OC Support Services with Family Support Network:

**Outcome was not met in FY 2023-24 due to not capturing survey data correctly (database didn’t capture the correct number of surveys, number of those that didn’t have access to survey were not removed from the count) and survey staff being on leave. Survey data is now collected manually to meet the outcome.

***Contractor has had difficulty in receiving full participation from survey respondents. New strategies put in place have ensured 100 percent response rates from agency staff, but participants and their families do not respond to surveys even after multiple contact attempts. Proposing to amend this outcome to being met if a minimum of five attempts at contacting prospective survey respondents are made. Please see Attachment F for more information on the proposed change to an outcome.

 

From July 1, 2023, through January 26, 2026, Wrap OC received a total of 1,003 new referrals. Of these referrals, 75 percent were SSA participants, 19 percent were HCA participants, and 6 percent were Probation participants. Probation’s caseload has decreased significantly as Probation participants transitioned to HCA’s Youthful Offender Wraparound program.

 

The Contractors’ performance has been confirmed as satisfactory. SSA has verified there are no concerns that must be addressed with respect to Contractors’ ownerships/names, litigation status or conflicts with County interests. The Orange County Preference Policy is not applicable to these Amendments. The non-profits have been verified to be in good standing.

 

An analysis was completed to verify the contract provides County with persons specially trained, experienced, expert and competent to perform the special services in accordance with the law. 

 

Non-Standard Insurance Provisions

The Contracts require Per Occurrence Sexual Misconduct Liability (SML) Insurance. Effective January 1, 2024, new state law eliminated the existing time limit for the statute of limitations on childhood sexual assault. Under the new law, a civil claim for a child sexual abuse event that occurs after January 1, 2024, can be brought at any time. Due to the significant potential liability the new law poses, many insurance providers are either unwilling to issue Per Occurrence SML or issue Per Occurrence policies at an affordable premium. Per Occurrence SML does not have a timeline limitation when a claim is filed and coverage applies, as long as the policy was active at the time of the incident. With Claims-Made SML, there is a specific, limited time period when a claim filed would be covered. If the Contractors are unable to find an insurance carrier to provide Per Occurrence SML due to the type of services provided, the Contractor(s) will carry Claims-Made SML Insurance and will be required to maintain this insurance throughout the term of the Contract in lieu of Per Occurrence SML Insurance. Risk Management cannot approve Claims-Made SML, and the ability to carry Claims-Made SML in lieu of Per Occurrence SML is before the Board for approval due to the critical importance of the services. See Attachment G for the Risk Assessment Form.

 

SSA now requests the Board’s approval to renew and amend Contracts with New Alternatives, Inc., Olive Crest, South Coast Community Services and Family Support Network for Wrap OC Direct and Support Services effective July 1, 2026, through June 30, 2028, for a revised cumulative total amount not to exceed $54,125,000. Prior to contract expiration, SSA plans to issue a solicitation to continue services.

These Contracts do not currently include subcontractors or pass through other providers. See Attachment H for the Contract Summary Form.

 

 

 

FINANCIAL IMPACT:

 

Appropriations for these Contracts will be included in the Budget Control 063, Social Services Agency FY 2026-27 Budget and will be included in the budgeting process for future years.

 

These Contracts are funded by 85 percent Wraparound Trust Fund, and 15 percent state CalWORKs Family Stabilization. Wraparound Trust funds comprise 40 percent State 2011 Realignment, and 60 percent County general funds which can only be reinvested in children’s programs. Probation will reimburse SSA for any referrals based upon their proportionate share of the services provided using 100 percent County general funds.

 

Contingency of Funds

The proposed Contracts include provisions that the Contracts are contingent upon the availability of funds and inclusion of sufficient funds in the budget approved by the Board for each fiscal year the Contracts remain in effect or operation. In the event such funding is terminated or reduced, the County may terminate the Contracts, reduce the County’s maximum obligation or modify the Contracts, without penalty.
