RECOMMENDED ACTION(S):

 

 

1.

Accept bid and award contract to Griffith Company in the amount of $1,874,478 for the Dana Point Harbor Intersection and Roadway Improvements Project.

 

2.

Authorize execution of contract by the Chair of the Board of Supervisors when the required bonds and insurance certificates have been submitted and approved by County Executive Office/Risk Management and County Counsel with the date of the contract effective upon execution.

 

3.

Authorize return of bid security to all bidders after contract execution.

 

 

 

 

SUMMARY:

 

Award of contract to Griffith Company in the amount of $1,874,478 for the Dana Point Harbor Intersection and Roadway Improvements Project will alleviate traffic issues created by the increase in traffic since the intersections were initially constructed.

 

 

 

 

 

BACKGROUND INFORMATION:

 

In their current configurations, the intersections at Casitas Place and Dana Point Harbor Drive and Puerto Place and Dana Point Harbor Drive need signal improvements.Since the time when these intersections were initially constructed, the Harbor has experienced an increase in visitor traffic which includes pedestrian and vehicular traffic.This was an anticipated need during the development of the Harbor Revitalization Project designs and this project is considered phase one towards the Harborís overall improvements as identified in the Coastal Development Permit (CDP) approved by the City of Dana Point. Additionally, this project will also address some improvements that are needed along Casitas Place, Puerto Place and portions of Dana Point Harbor Drive near these intersections.A traffic study (Attachment D) was performed in August 2012 to assess the current intersections in anticipation of the Revitalization Project improvements.This study confirms the identified construction as a necessary element for the Revitalization of Dana Point Harbor.

 

The contract award and authorization to start construction of the Intersection and Roadway Improvements Project (Project) at Casitas Place, Puerto Place and Dana Point Harbor Drive provides for signal upgrades at the two intersections, roadway improvements to the three streets and some minor work to three adjoining parking lots.This begins the initial phase of the overall Dana Point Harbor Revitalization Project.Once completed, these intersection and roadway improvements will aid Harbor visitors while traveling to and through Dana Point Harbor.Specifically, the construction at the Casitas Place and Dana Point Harbor Drive will provide for signal upgrades at the intersection, the addition of a right turn pocket from Casitas Place to Dana Point Harbor Drive and a crosswalk across Dana Point Harbor Drive on the easterly side of the intersection. There will also be some minor utility work and improvements to the adjacent easterly parking lot.

 

The Puerto Place and Dana Point Harbor Drive construction will provide for: signal upgrades at the intersection, median and parkway improvements, the addition of a right turn pocket from Dana Point Harbor Drive onto Puerto Place, the addition of a second left turn pocket from Dana Point Harbor Drive onto Puerto Place and roadway improvements along Puerto Place. The work in the westerly parking lot along Puerto Place will consist of removal of the buildings within the existing OC Parks Operations and Maintenance yard, minor grading and driveway improvements. The work in the easterly parking lot will consist of driveway and sidewalk improvements.This begins the initial phase of the overall Dana Point Harbor Revitalization Project. Once completed, these intersection and roadway improvements will aid Harbor visitors while traveling to and through Dana Point Harbor.

 

The Project will include needed traffic controls during construction to mitigate any adverse impacts caused by the construction. As part of the permitting process, OC Dana Point Harbor (OC DPH) has received a CDP from the City of Dana Point in January 8, 2015. The City approved the CDP application finding it in compliance with the Local Coastal Plan. The Permit has gone through the appeal process at the City and Coastal Commission and has been upheld as valid. The City retains ownership of a portion of Dana Point Harbor Drive within the Tidelands boundary, and partially within this project area.The work from this project contained within the City of Dana Point ownership will be completed using Tidelands Funds as allowed by the State Lands Commission and performed under an encroachment permit issued from the City of Dana Point.

 

The Project Plans and Specifications were approved by the Board for advertisement on October 27, 2015 with a bid opening date set for December 16, 2015.

 

Nine Bid proposals for the subject project were received and opened on December 16, 2015.Of the nine bids received, three bids were determined to be Non-Responsive. A summary of the six Responsive bids received (including the Engineer's Estimate) is as follows:

The lowest responsive and responsible bid submitted by Griffith Company of $1,874,478.00 for this Project is approximately 10.7% below the Engineerís Estimate of $2,100,000. OC DPH has reviewed the Engineer's Estimate and verified that the difference is not the result of errors or omissions in the estimate, but is rather attributed to the competitive environment, the Contractorís risk tolerance and the technical complexities of the Project. OC DPH concludes that the low bid is fair and reasonable for the work to be done and not unrealistic.It is recommended to award this contract to Griffith Company (Contractor) for an amount of $1,874,478.00.

 

OC Public Works has verified the Contractor's license through the California State License Board and has found license number 88 to be current and active.OC DPH and OC Public Works have reviewed the Contractor's references and qualifications and find that the Contractor is responsible and has deemed its bid to be the lowest responsive and responsible bid.Reference checks were also completed with the City of Chino Hills and County of Riverside regarding similar projects and were found to be satisfactory.Griffith has completed similar projects at OC Public Works as well.

 

This contract includes six subcontractors.See Attachment C, Contract Summary Form for additional information regarding the subcontractors.

 

OC Public Works is facilitating the procurement of this contact in accordance with the Design & Construction Policy Manual Section 1.1.OC DPH shall be responsible for the contract administration and funding.

 

Compliance with CEQA:This Project is a necessarily included element of the projects considered in Final EIR No. 591, certified by the Board on January 31, 2006 and an Addendum thereto approved by the Board on December 11, 2012 (Resolution No. 12-177), which togetheradequately addressed the effects of the proposed project. No substantial changes have been made in the project, no substantial changes in the circumstances under which the project is being undertaken and no new information of substantial importance to the project which was not known or could not have been known when the Final EIR No. 591 was certified or when the Addendum thereto was approved has become known therefore no further environmental review is required.

 

 

 

FINANCIAL IMPACT:

 

Appropriations and revenue for this Agreement are included in the FY 2015-16 Modified Budget.The contract includes a Termination for Convenience Clause which states the County may terminate the contract in whole or in part at any time with a 30-day notice.
