RECOMMENDED ACTION(S):

 

 

1.

Find that the project is categorically exempt from the CEQA, Class 1 (Existing Facilities) pursuant to CEQA Guidelines section 15301.

 

2.

Authorize the County Procurement Officer or Deputized designee to execute Contract MA-012-24010169 with AquaTechnex, LLC for lake management and lake water quality maintenance services at various regional and wilderness park facilities, effective March 11, 2024, through March 10, 2027, in an amount not to exceed $855,000 annually for a three-year cumulative contract total amount not to exceed $2,565,000, with the option to renew for one additional two-year term.

 

 

 

 

 

SUMMARY:

 

Approval of the Contract with AquaTechnex, LLC will support public fishing, promote good water quality, and enhance the positive recreational and aesthetic experiences of park visitors at lakes and ponds throughout OC Parks facilities.

 

 

 

BACKGROUND INFORMATION:

 

OC Community Resources/OC Parks (OCCR/OC Parks) manages 18 lakes and seven ponds located in various regional and wilderness parks facilities throughout Orange County that require lake management and maintenance services (Services). These Services include, but are not limited to, water quality monitoring and evaluation, weed and algae control, waterfowl habitat management, consultation on lake dredging and sedimentation issues, assistance with established fish stocking programs, aeration/recirculation system management and diagnosis and regulatory compliance with local, state and federal agencies. After an evaluation of internal resources, it was determined that it would be more cost effective to utilize private contractors to perform necessary Services at these facilities due to the required level of expertise. The Services are necessary to monitor water quality, maintain sustainable fish populations and improve and maintain the aquatic environment of OCCR/OC Parks lakes and ponds.

 

OCCR/OC Parks is currently contracted with AquaTechnex, LLC (AquaTechnex) for Services. The following table details the recent history of OCCR/OC Parks’ contract with AquaTechnex:

Prior to the expiration of the contract, a Request for Proposal for Services was posted on September 1, 2023, on OpenGov, the County’s bidding system. One responsive written proposal was received by the solicitation deadline of October 2, 2023. The written proposal was evaluated by a panel comprised of five subject matter experts with experience in natural resources management, park operations and maintenance, environmental resources and integrated pest management and sustainability.

 

The written proposal was rated based on the following predetermined criteria with an overall weight of 75 percent:

During the oral interview, the respondent was asked predetermined questions and rated based on predetermined criteria with an overall weight of 25 percent. The weighted score is summarized below. Attachment A includes the individual evaluator scores for the respondent.

Based on the total scores, the evaluation panel recommended award of the contract to AquaTechnex. The proposed Contract MA-012-24010169 (Contract) with AquaTechnex has a term effective March 11, 2024, through March 10, 2027, in an amount not to exceed $855,000 annually for a three-year cumulative contract total amount not to exceed $2,625,000, with the option to renew for one additional two-year term.

 

AquaTechnex is a qualified firm based in Southern California with over 40 years of experience related to the Services under the Contract. This contract allows for possible use of a subcontractor laboratory for water sample analysis. See Attachment C for the Contract Summary Form. OCCR/OC Parks has verified there are no concerns that must be addressed with respect to the vendor’s ownership/name, litigation status or conflicts with County interests. The Orange County Preference Policy is not applicable to this contract. No protests were received. Reference checks have been conducted with The Hideaway Golf Community, Santa Ana Watershed Project Authority and the City of Bremerton Public Works Department and were satisfactory.

 

Compliance with CEQA: The proposed project is Categorically Exempt from CEQA pursuant to CEQA Guidelines Sections 15301 (Class 1) because the exemption provides for a contract agreement for the management and maintenance of existing public facilities with negligible or no expansion of existing use.

 

 

 

FINANCIAL IMPACT:

 

Appropriations for this Contract are included in OC Parks Fund 405 FY 2023–24 Budget and will be included in the budgeting process for future years.

 

The proposed Contract includes a provision stating the Contract is subject to, and contingent upon, applicable budgetary appropriations approved by the Board for each fiscal year during the term of this Contract. If such appropriations are not approved, this Contract may be immediately terminated without penalty to the County.
