RECOMMENDED
ACTION(S):
Authorize the
Director of Public Works or designee to execute Contract Change Order No. 7 to
the contract with Kasa Construction Inc. for an additional 6,450 cubic yards of
import soil for the Crawford Canyon Park and Sidewalk Extension Project in an
amount not to exceed $419,250, for a revised cumulative total amount not to
exceed $6,329,729 and an additional 23 calendar days to complete grading.
SUMMARY:
Approval of
Contract Change Order No. 7 to the contract will allow for the completion of
grading at Crawford Canyon Park to provide a community park for residents in
the unincorporated community of North Tustin and connectivity to the park by
means of Americans with Disabilities Act compliant pedestrian pathways.
BACKGROUND
INFORMATION:
On March 15, 2011,
the Board of Supervisors (Board) authorized County of Orange (County) staff to
pursue the acquisition and development of a community park or other
recreational opportunities within or to the benefit of the North Tustin
unincorporated Orange County area. To that end, a property of approximately 2.5
acres (Property) located at the corner of Newport Avenue (Newport) and Crawford
Canyon Road (CCR), within the boundaries of the North Tustin Landscape and
Lighting Assessment District (District) was identified as a potential site for
Crawford Canyon Park (Park). The Property was purchased for $980,000 utilizing
County Local Park Trust Fund 153, an account used to hold developer park
in-lieu fees. Acquisition of the Property was subsequently finalized and the
deed recorded on November 29, 2011.
On April 25, 2017,
the Board adopted Resolution 17-041 that identified the Property for park
purposes and authorized the use of District Fund (Fund) 459 to construct and
maintain the Park. Fund 459, contributed to by property owners within the
District, pays for the maintenance, operation and improvement of County parks
and trails within its boundaries. Subsequently, on September 11, 2018, the
Board adopted the Clearwater at North Tustin Development Agreement (Agreement).
The Agreement resulted in $850,000 in-lieu of developer fees that are being
used for the Crawford Canyon Park and Sidewalk Extension (Project). The Project
would construct a 2.5-acre park consisting of various recreational amenities
and existing sidewalks along Newport. CCR would also be extended to provide
Americans with Disabilities Act compliant pedestrian pathways.
On January 10,
2024, OC Public Works issued an Invitation for Bid for the Project. The lowest
responsive and responsible bid was submitted by Kasa Construction Inc.
(Contractor).
On April 9, 2024,
the Board awarded Contract MA-012-24011000 (Contract) to the Contractor for the
Project, in the amount of $5,787,621, with completion of construction within
320 days of the effective date of the Notice to Proceed, which was dated June
3, 2024.
In accordance with
the 2024 Contract Policy Manual (CPM), Section 3.5-108, the OC Public Works
Director’s designee executed Contract Change Orders (CCO) in order to address
needs that arose during the Project. The CCOs and their respective amounts are
summarized in the table below.

The original bid
documents estimated 3,600 CY of imported soil was needed to complete the
Project. During initial grading operations, the Contractor discovered there was
insufficient imported soil to meet the design elevations and an additional 409
CY of soil was imported to the site (CCO No. 3). However, an additional 6,450
CY of import soil is needed to meet the design elevations.
The discrepancy
between the amount of soil to be delivered in the original bid for the Project
and the actual amount needed to satisfy the design needs for the Park can be
attributed to several factors, including higher than anticipated compaction of
the soil already on the Property and high amounts of existing vegetation that
concealed the true elevation of Property where soil was needed. The combination
of these factors significantly overestimated the amount of onsite soil
available for the Project.
Grading activities
for the additional imported soil will also result in delays to the overall
Project schedule. The Resident Engineer (RE) reviewed the Contractor’s Time
Impact Analysis (TIA) request for additional contract days. The RE determined
that 23 additional calendar days (17 working days) are required to complete the
grading based upon the Contractor's TIA and the rate at which the soil has been
placed to date.
OC Public Works is
recommending the Board approve CCO No. 7 with the Contractor in an amount not
to exceed $419,250, for a revised cumulative total amount not to exceed
$6,329,729 and an additional 23 calendar days (17 working days) to complete
grading.
The Contractor’s performance has been
confirmed as satisfactory. OC Public Works has verified there are no concerns
that must be addressed with respect to Contractor’s ownership/name, litigation
status or conflicts with County interests.
Compliance
with CEQA: This
project is a necessarily included element of the project considered in Final
Mitigated Negative Declaration (MND) No. IP-21-093 approved by the Board of
Supervisors on September 14, 2021, for the Crawford Canyon Park and Sidewalk
Extension Project, which adequately addressed the effects of the proposed
improvements. No substantial changes have been made in the project, no
substantial changes have occurred in the circumstances under which the project
is being undertaken and no new information of substantial importance to the
project which was not known or could not have been known when the Final MND No.
IP-21-093 was approved has become known; therefore, no further environmental
review is required.
FINANCIAL IMPACT:
Appropriations for
CCO No. 7 are included in Fund 459, North Tustin Lighting and Landscape
Assessment District, FY 2024-25 Budget.
