RECOMMENDED ACTION(S):

 

 

1.

Find that the project is categorically exempt from CEQA, Class 1 (Existing Facilities) pursuant to CEQA Guidelines Section 15301.

 

2.

Authorize the County Procurement Officer or Deputized designee to execute a contract with SCA of CA, LLC for Street Sweeping Services, effective February 10, 2025, through February 9, 2028, in an amount not to exceed $3,025,000, with the option to renew for one additional two-year term.

 

 

 

 

SUMMARY:

 

Approval of a contract for Street Sweeping Services will allow OC Public Works to prevent debris from entering the storm drain system in the unincorporated areas of Orange County to enhance public health and safety.

 


 

 

BACKGROUND INFORMATION:

 

The County of Orange (County) and the cities of Orange County are co-permittees on the National Pollutant Discharge Elimination System (NPDES) permits issued by both the Santa Ana and San Diego Reginal Water Quality Boards. The County and cities are each required, under the NPDES permits, to implement best management practices to reduce pollutants before they enter the public storm drain system and to prevent conveyance of debris to harbors, bays and coastal waters.

 

OC Public Works utilizes contractors to perform Street Sweeping Services (Services) to prevent debris from entering the storm drain system in the unincorporated areas of Orange County.

 

On February 4, 2020, in accordance with the 2019 Contract Policy Manual (CPM), Section 3.3-102 (1), which authorized the County Procurement Officer (CPO) or Deputized designee (DPA) to execute contracts with annual value of $200,000 or less, the DPA executed Contract MA-080-20011167 with Jonset Corporation, DBA Sunset Property Services (Jonset), for a five-year term effective February 10, 2020, through February 9, 2025, in an annual amount not to exceed $60,000, for a cumulative total amount not to exceed $300,000. This contract is utilized for Services in locations within the County’s jurisdiction in the northern portion of Orange County.

 

In order to provide Services in locations in the County's jurisdiction in the southern portion of Orange County, the  Board of Supervisors (Board) approved Contract MA-080-22010531. Additional CPO or DPA actions related to this contract are summarized in the table below.

In an effort to consolidate Services for both northern and southern locations into a single contract, on September 26, 2024, OC Public Works issued an Invitation for Bid for Services on the County online bidding system. One bid was received. The lowest responsive, responsible bidder, incumbent Contractor, was deemed qualified to perform the needed Services. The Bid Summary is included as Attachment C.

 

OC Public Works is procuring these Services in accordance with the 2024 CPM Section 3.3.102. The Orange County Preference Policy (OCPP) was applicable and incorporated into this solicitation; however, no OCPP qualified proposals were submitted.


 

 

OC Public Works is recommending the Board approve Contract MA-080-25010266 (Contract) with the Contractor for Services, effective February 10, 2025, through February 9, 2028, in an amount not to exceed $3.025 million with the option to renew for one additional two-year term upon Board approval. Contract MA-080-22010531, which expires on April 30, 2025, will be terminated for convenience upon the Board's approval of the proposed Contract.    

 

OC Public Works has conducted due diligence on the Contractor. Reference checks were satisfactory and completed with Hollywood Media District, City of Costa Mesa and City of Manhattan Beach regarding similar services. OC Public Works has verified there are no concerns that must be addressed with respect to the Contractor’s ownership/name, litigation status or conflicts with County interests.

 

This Contract does not currently include subcontractors or pass through to other providers. See Attachment B for the Contract Summary Form.

 

The Contract is being presented for Board consideration less than 30 days before its effective date due to additional negotiation time required, which resulted in a two percent reduction in rates over those proposed in the Contractor's bid documents.

 

Compliance with CEQA: The proposed project is Categorically Exempt (Class 1) from the provisions of CEQA pursuant to CEQA Guidelines Section 15301, because it involves the approval of a contract for the maintenance of existing public facilities involving negligible or no expansion of existing use.

 

 

 

FINANCIAL IMPACT:

 

Appropriations for the Contract are included in Fund 115, OC Road, FY 2024-25 Budget and will be included in the budgeting process for future years.

 

The proposed Contract includes a provision stating the Contract is subject to, and contingent upon, applicable budgetary appropriations being approved by the Board for each fiscal year during the term of this Contract. If such appropriations are not approved, this Contract may be immediately terminated without penalty to the County.
