RECOMMENDED

SUMMARY:
Approval of the
amended Human Relations Commission Bylaws will allow for greater efficiency and
clarity of the role of the Human Relations Commission.
BACKGROUND
INFORMATION:
The Orange County
Human Relations Commission (HRC) was created by the Board of Supervisors on
February 24, 1971. The Board previously approved amendments to the HRC Bylaws
on December 14, 1982, November 19, 1985, September 22, 2015, October 31, 2017,
and June 28, 2022.
On June 25, 2024,
the Orange County Board of Supervisors approved the FY 2024-25 Budget which
included direction to the County Executive Office to transfer the function of
staffing for the Orange County Human Relations Commission from contracted
services to County staff. As a result,
the Groundswell contract ended on June 30, 2024, and was not renewed.
On August 13,
2024, the Board of Supervisors created a Human Relations Commission Ad Hoc (Ad
Hoc) consisting of Chairman Wagner and Supervisor Foley. The Ad Hoc reviewed the bylaws and the
updated bylaws are recommended for approval by the Board.
The recommended
amendments to the HRC bylaws include an update to the Commission membership
which include the removal of the role of the City Selection Committee and
strengthening the Board of Supervisors’ role in appointing members to the
Commission by adding one additional at-large appointed member to the Commission
from the District Attorney’s Office. Other bylaws changes include: amend the Commission
meeting schedule; change the nomination of the Chair and Vice-Chair to the
first Commission meeting of the year; clarify that the Commission is to assist
in the preparation of an annual report pursuant to the Government Code
50265(s); amend Commission roles so that the Commission is not authorized to
make statements, press releases or reports on behalf of the Commission; remove
the authority of the Commission to establish standing or executive committees;
and remove proxy voting.
As the recommended
HRC membership no longer includes City Selection Committee representatives, the
City Selection will be directed not to appoint commissioners to any vacant
positions at its November 2024 meeting. All current members appointed by the
City Selection Committee will have their term terminated effective December 31,
2024.
Due to the
transition from the contracted services to in-house, County staff continues to
work on the 2023 Hate Crime report and will submit it to the Board by the end
of the calendar year.
