RECOMMENDED ACTION(S):

 

 

1.

Approve retroactive First Amendment to extend the Master Agreement for Group Home Services for an additional 12-month period, effective January 1, 2020, through December 31, 2020.

 

2.

Authorize the Social Services Agency Director, or designee, to execute First Amendment for Group Home Services with qualified California licensed Group Home providers for the period of January 1, 2020, through December 31, 2020.

 

 

 

 

SUMMARY:

 

Approval of Amendment for the Group Home Master Agreement will allow the Social Services Agency and the Probation Department to continue to access residential care and support services for children and youth under the jurisdiction of the Juvenile Court when this level of care is required.

 

 

BACKGROUND INFORMATION:

 

The Social Services Agency (SSA) is requesting the Board of Supervisors’ (Board) approval of a retroactive amendment to extend the Master Agreement for Group Home Services, for an additional 12-month period, effective January 1, 2020, through December 31, 2020.

 

On November 20, 2018, the Board approved the most recent master agreements for Short-Term Residential Therapeutic Program (STRTP) Services for the period of January 1, 2019, through June 30, 2021, and for Group Home Services for the period of January 1, 2019, through December 31, 2019, for a cumulative total maximum obligation of $30,815,601, for the period of January 1, 2019, through June 30, 2021.

 

On October 11, 2015, Assembly Bill (AB) 403 was signed into law.  AB 403 codifies recommendations contained in the report released by the California Department of Social Services (CDSS) entitled California’s Child Welfare Continuum of Care Reform (CCR).  The goal of CCR is to improve the child welfare system through the elimination of long-term group home placements and the increased utilization of home-based care for foster children.  As a result of the passage of AB 403, any group home serving children and youth under the jurisdiction of Juvenile Court was asked to transition to a new type of facility called STRTP by December 31, 2018.  STRTPs will provide short-term, specialized and intensive treatment to children and youth whose needs cannot be safely met initially in a family setting.  In August 2018, CDSS notified counties that rate extensions for group homes will be permitted on a case-by-case basis from January 1, 2019, through December 31, 2019.

 

Some group homes in California have not yet received their license to become an STRTP.  As a result, on December 4, 2019, CDSS notified counties that rate extensions for the group home rate would be permitted on a case-by-case basis after December 31, 2019, and detailed the requirements necessary for both counties and providers to receive an extension of their group home rate. There are currently two contracted providers under the current Master Agreement for Group Home Services: one contracted group home provider, Casa Youth Shelter, has decided not to move forward with transitioning to a STRTP, and one contracted group home provider, Hart Community Homes, Inc., has an STRTP application pending with the state for approval. As such, SSA is requesting the Board approve a one-year extension to the current Group Home Master Agreement should these two providers receive an extension of their Rate Classification Level payment rate by the state, in order to continue to utilize these group homes as placement options for youth.

 

SSA is bringing this item retroactively, as January 14, 2020, was the first possible Board meeting after receiving state notification in early December about the possibility to extend usage of group homes.

 

SSA has provided residential care and support services for foster children/youth in group homes since 1984.  Group homes and STRTPs provide a critical placement resource for children/youth with significant behavioral and mental health challenges and operate with the goal of transitioning children/youth into lower levels of care.  Children/youth are placed in group homes and STRTPs when there are no other placements that can meet the child/youth’s needs.

 

The Contractors’ performance of these two providers have been confirmed as satisfactory. SSA has verified there are no concerns that must be addressed with respect to Contractor’s ownership/name, litigation status or conflicts with County interests.

This Agreement does not currently include subcontractors or pass through to other providers.  See Attachment C for Contract Summary Form.

 

 

 

 

FINANCIAL IMPACT:

 

Appropriations for this Agreement are included in the Budget Control 063 FY 2019-20 Budget and will be included in the budgeting process for future years.

 

The Master Agreements will be funded with Federal Title IV-E 24 percent; State 2011 and State 1991 Realignment 54 percent; and County General funds 22 percent. General Fund costs will be used towards the required match to access federal and state funding.  The County will pay the state-established rates when children are placed with Group Home and STRTPs.

 

Contingency of Funds

 

The proposed Agreement includes provisions that the Agreement is contingent upon the availability of funds and inclusion of sufficient funds in the budget approved by the Board for each fiscal year the Agreement remains in effect or operation.  In the event such funding is terminated or reduced, the County may terminate the Agreement, reduce the County’s maximum obligation or modify the Agreement, without penalty.
