RECOMMENDED ACTION(S):

 

 

1.

Find that the subject activity is not a project within the meaning of CEQA Guidelines Section 15378 and is therefore not subject to review under CEQA. 

 

2.

Approve and execute an Architect-Engineer Agreement with Twining for on-call geotechnical engineering, materials testing, construction observation and inspection services in the not-to-exceed amount of $1.5 million, effective upon Board of Supervisors’ approval for a three-year term, with the option to renew for two additional years.

 

3.

Approve and execute an Architect-Engineer Agreement with Langan for on-call geotechnical engineering, materials testing, construction observation and inspection services in the not-to-exceed amount of $1.5 million, effective upon Board of Supervisors’ approval for a three-year term, with the option to renew for two additional years.

SUMMARY:

 

Approving and executing Architect-Engineer Agreements with Twining and Langan and approving and executing Amendments to Architect-Engineer Agreements with Ninyo & Moore and Kleinfelder will allow for continued and uninterrupted on-call geotechnical engineering, materials testing, construction observation and inspection services in support of John Wayne Airport’s Capital Improvements Program and other airport projects.

 

 

 

BACKGROUND INFORMATION:

 

John Wayne Airport (JWA) maintains a group of consultants (engineers, inspectors, technicians and observers) at all times to maintain a safe and operable airport through efficient delivery of airport infrastructure, planning, capital improvements and development services. The use of on-call agreements expedites the process of providing these necessary services.

 

The Architect-Engineer Agreements (Agreements) will be used to provide on-call geotechnical engineering, materials testing, construction observation and inspection services for JWA projects. The extension of the existing contracts will ensure that interruptions to construction or operation of essential airport facilities are minimized. In addition, the scope of these Agreements includes Architect-Engineer services for emergency and miscellaneous projects that are anticipated but cannot be defined until the need occurs. The projects include new construction, maintenance, repair and alteration throughout JWA that require engineers, inspectors, technicians and/or observers. The Agreements are for services to be provided on an “as-needed/on-call” basis. Requested services are subject to JWA’s approval with a not-to-exceed dollar amount for each task.

 

JWA is facilitating the procurement of these Agreements in accordance with the 2019 County of Orange Design & Construction Procurement Policy Manual (DCPM). A Request for Qualifications (RFQ) was advertised and firms submitted a Statement of Qualifications (SOQ).

 

Agreements with Twining and Langan

 

After a solicitation process, Twining and Langan were selected for award of the Proposed Agreements. 

 

On July 17, 2019, JWA issued an RFQ to solicit SOQs from firms to provide on-call geotechnical engineering, materials testing, construction observation and inspection services. The RFQ was advertised through August 14, 2019, and 13 SOQ submittals were received. On September 6, 2019, the evaluation committee completed the written evaluation process and provided recommendations. Based on the criteria set forth in the RFQ, the firms listed in Attachment F were recommended for establishment of a Qualified Vendor List for on-call geotechnical engineering, materials testing, construction observation and inspection services and were invited for interviews. On September 26, 2019, the evaluation committee completed interviews with the firms and provided recommendations. Agreements with the three top-ranked firms were negotiated based on the criteria set forth in Section 3.3-105 of the DCPM. The rating summary and individual score sheets are provided as Attachment E. JWA staff have conducted due diligence on recommended new contractors, Twining and Langan. Reference checks were satisfactory and completed for both firms with Los Angeles World Airports, Corgan Architects, Saiful/Bouquet Structural Engineers and PCL Construction regarding similar projects. Incumbent Ninyo & Moore's existing contract is recommended for amendment as explained below.

 

Amendments with Ninyo & Moore and Kleinfelder

 

On January 24, 2017, the Board of Supervisors (Board) approved agreements with Ninyo & Moore and Kleinfelder for on-call geotechnical engineering, materials testing, construction observation and inspection services, effective January 24, 2017, through January 23, 2020, renewable for two one-year terms. The proposed Amendment No. 1 to the Agreement with Ninyo & Moore adds the amount of $660,000 for a new not-to-exceed amount of $1.65 million and extends the term of the Agreement for two years. Currently, Ninyo & Moore is designated to provide testing, special inspection and/or geotechnical engineering services for the Terminal C Gate 14 Holdroom Improvements, North Remain Over Night Hydrant Piping System Leak Repair Project, Concessions Utilities Project and Terminal Building Modifications, among others.

 

The proposed Amendment No. 1 to the Agreement with Kleinfelder adds the amount of $660,000 for a new not-to-exceed amount of $1.65 million and extends the term of the Agreement for two years.  Currently, Kleinfelder is designated to provide testing, special inspection and/or geotechnical engineering services for the Biological Explosive Detection System Facility Replacement, Electric Vehicle Parking Stall Signage Project, Terminal Building Modifications and the 3160 Airway Avenue Employee Lot Rehabilitation Project, among others. The Amendments include increases in the hourly rates for the various classifications and materials testing that were negotiated with each firm and are in line with the published Consumer Price Index increases for the Los Angeles-Long Beach-Anaheim area over the relevant period. JWA’s experience with Ninyo & Moore and Kleinfelder has been confirmed as at least satisfactory. JWA has verified there are no concerns that must be addressed with respect to both Contractors' ownership/name, litigation status or conflicts with County interests.

 

The proposed Agreements, Amendments, scope of services and negotiated rates are included as Attachments A through D. The negotiated hourly rates and fees are within industry standards and are fair and reasonable for the services being provided under the Agreement. The Agreements include subcontractors. See Attachments G through J for information regarding the subcontractors and the Contract Summary Forms.

 

Based on the information noted above, JWA seeks Board approval of the proposed Agreements with Twining and Langan and approval of the Amendments with Ninyo & Moore and Kleinfelder for on-call geotechnical engineering, materials testing, construction observation and inspection.

 

Compliance with CEQA: This action is not a project within the meaning of CEQA Guidelines Section 15378 and is therefore not subject to CEQA since it does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. The approval of this agenda item does not commit the County to a definite course of action in regard to a project since it is an award for A-E services for potential future projects that are not yet known. This proposed activity is therefore not subject to CEQA. Any future action connected to this approval that constitutes a project will be reviewed for compliance with CEQA.

 

 

 

FINANCIAL IMPACT:

 

Appropriations for the Agreements and Amendments are included in the FY 2019-20 Airport Operating Fund 280 and Airport Construction Fund 281 and will be included in the budgeting process for future years.

 

The proposed contracts include a provision stating the contracts are subject to and contingent upon the availability of local, state or federal government funds. If such funds are not approved, these agreements may be immediately terminated without penalty to the County.
