RECOMMENDED ACTION(S):
Approve the amendments to the In-Home Supportive Services Advisory Committee Bylaws as approved by the In-Home Supportive Services Advisory Committee on October 17, 2019.
SUMMARY:
Approval of the amendments to the In-Home Supportive Services Advisory Committee's Bylaws will clarify the duties and membership composition of the Advisory Committee, as well as the nature of the Committee's meetings and administrative support functions.
BACKGROUND INFORMATION:
The In-Home Supportive Services (IHSS) Advisory Committee is requesting the Board of Supervisors’ (Board) approval of the amendments to the IHSS Advisory Committee Bylaws.
On June 13, 2000, the Board directed the Social Services Agency (SSA) to establish an 11 member IHSS Advisory Committee as required under former Welfare and Institutions Code (WIC) Section 12301.3 and authorized SSA to solicit applications for membership. The Advisory Committee is guided by Bylaws that are approved by the Board, the first set of which were approved on September 13, 2005. The Board approved of the current Advisory Committee Bylaws on September 22, 2015, when the Advisory Committee amended the 2005 Bylaws, to state that a nominee to the IHSS Advisory Committee must be a resident of the County of Orange, but may reside outside of the supervisorial district of the recommending Supervisor provided that the written consent of the Supervisor in whose district the nominee resides is obtained.
On October 17, 2019, the IHSS Advisory Committee unanimously approved to amend its bylaws and requested that SSA bring those amendments before the Board for approval. The proposed bylaw amendments update the Advisory Committee's duties and membership composition and the nature of the Committee's meetings and administrative support functions, as well as updates certain terminology in the bylaws. The term "consumer" in the bylaws has been replaced with "recipient" to better align with the language used in the current Memorandum of Understanding between the County of Orange and the Orange County IHSS Public Authority, approved by the Board on May 21, 2019.
Additional proposed amendments to the bylaws include the renaming of the Membership Ad Hoc Committee to the Candidacy Ad Hoc Committee, and the addition of language that establishes all Committee members are expected to attend both regular and special meetings, rather than just regular meetings. Members will now be expected to provide 48 hours' notice to the Advisory Committee Chair, Public Authority Director and/or the Clerk of the Board when attendance is not possible. The proposed amendments also afford the Advisory Committee Chair the ability to delegate responsibilities from one officer to another on all ad hoc committees, except the Candidacy Ad Hoc Committee. Additionally, amended language provides that the election of officers will commence the last scheduled meeting of each fiscal year, as opposed to the first scheduled meeting of the calendar year.
The composition of the Committee members has also been updated to clarify that members should be residents of Orange County and registered to vote in-County and that one of the members should be a representative of a community-based organization or agency located in Orange County. The proposed amendments also provide that Committee activities are limited to an allocated budget and that the Clerk of the Board will provide administrative support functions through the budgeted state and federal allocation for the advisory committee as the source of funding for Clerk of the Board administrative support was not identified in the current bylaws.
