RECOMMENDED ACTION(S):

 

 

1.

Per Title 24 Code of Federal Regulations Section 91.105, conduct a public hearing and consider public comments in City of Stanton Contract and consider public comments in First Amendment to the Contract with City of Yorba Linda.

 

2.

Authorize the OC Community Resources Director or designee to redirect FY 2019-20 capital improvements funds for Public Facilities and Improvements to FY 2019-20 Housing Rehabilitation projects for use under the Contract with the City of Stanton.

 

3.

Authorize the OC Community Resources Director or designee to execute the Contract with City of Stanton for Housing Rehabilitation effective upon Board approval through June 30, 2020, in the amount of $100,000.

 

4.

Authorize the OC Community Resources Director or designee to execute First Amendment to Contract with City of Yorba Linda for Administration, Senior Services, Single Family Rehabilitation and Americans With Disabilities Act projects in an amount not to exceed $78,385 effective upon Board approval through June 30, 2020, for a new contract total of $274,409.

 

 

 

 

SUMMARY:

 

Conducting a public hearing and authorizing OC Community Resources to redirect funds for Public Facilities and Improvements to Housing Rehabilitation for its contract with the City of Stanton, and approval to amend the City of Yorba Linda contract, will meet the requirements set forth in the FY 2019-20 Funding Allocation Policy and Process and Contract Policy Manual section 3.4-113,114 for substantial amendments in the use of Federal funding, increase Community Development Block Grant contract funding by $78,385 and allow for the expenditure of all funding allocated.

 

 

BACKGROUND INFORMATION:

 

The County of Orange (County) receives U.S. Department of Housing and Urban Development Community Development Block Grant (CDBG) funds and selects providers to perform services and expend these funds in the County.  For FY 2018-19 and FY 2019-20 County CDBG contract years, subrecipients (participating cities) were given the option in the FY 2018-19 Funding Allocation Policy and Process (FAPP) to redirect their approved project funds previously designated for other types of projects to Capital Improvements to Homeless Shelter(s).  Two participating cities, Stanton and Yorba Linda, utilized this option and requested the County to approve contracts for FY 2018-19 and FY 2019-20 Capital Improvements.  On June 4, 2019, the Board of Supervisors (Board) approved the providers and projects for Public Services, Housing Rehabilitation and Public Facilities and Improvements which included the contracts with the cities of Stanton and Yorba Linda.

 

Upon further review of Federal CDBG funding requirements for the construction of shelters, the cities of Stanton and Yorba Linda requested the County to reallocate the funds back to other types of Public Facilities and Improvements and Housing Rehabilitation activities.  The City of Stanton's request will change their scope of work from Capital Improvements back to their original approved application scope for Housing Rehabilitation activities in the amount of $100,000.  The City of Stanton's Housing Rehabilitation activities will include the rehabilitation of a minimum of 5 eligible Single-Family Residences.  The City of Yorba Linda's request will redirect $60,000 of their FY 2018-19 funds to their FY 2019-20 Americans with Disabilities Act (ADA) Improvements project which will provide for the improvements to ramps throughout the city.  In addition, HUD allocated an additional $18,385 that has been incorporated into Yorba Linda's First Amendment for Administration, Senior Services and Housing Rehabilitation projects for a total increase of $78,385 with a new contract total of $274,409. 

 

Under the FY 2019-20 FAPP that was approved by the Board on November 19, 2019, Board approval is required for Substantial Amendments to the scope of work, when a proposal is made to amend the description of an existing activity in such a way that the newly described purpose, scope or beneficiaries differ significantly from the original activities purpose, scope or beneficiaries. The County’s proposed Contract with the City of Stanton differs from the previously considered Contract and constitutes a Substantial Amendment to the Scope of Work, which requires Board approval.  Additionally, the First Amendment to the County’s contract with the City of Yorba Linda requires Board approval because the increased contract amount exceeds the contingency amounts allowed under the County of Orange 2019 Contract Policy Manual section 3.4-113,114.

 

 

FINANCIAL IMPACT:

 

Appropriations for these Contracts are included in the Budget Control 15G FY 2019-20 Budget and will be included in the budgeting process for future years.
