ACTION(S):
Approve and authorize the execution
of Amendment Number One to the sole source revenue agreement with Rancho
Santiago Community College District to increase the maximum number of
continuing education hours per Fiscal Year from 248,000 to 393,750 effective upon
Board approval through the term June 30, 2026.
SUMMARY:
Approval of Amendment Number One to
the sole source revenue agreement with Rancho Santiago Community College
District will allow the Sheriff-Coroner to increase continuing education hours
from 248,000 hours to 393,750 hours for Inmate Services.
BACKGROUND
INFORMATION:
Since 1988, Rancho Santiago
Community College District (District) has been contracting with the County for
the District to provide continuing education classes for inmates housed in
County jail facilities at no cost to the County. Four of the five County jail facilities are
within the boundaries of the District.
Because the District has been
providing adult education services to inmates in the County jail system over
the past 22 years, the District has invested significant curricular and
instructional resources into the program. The classes provided for inmates by
the District include subject areas such as adult basic education, citizenship,
English as a second language, High School Equivalency Test (HiSET) preparation,
health issues, parenting, substance abuse and workforce preparation. The
District will claim state apportionment for student attendance generated in the
classes covered by this agreement.

Agreement
renewed pursuant to County’s 2012 Contract Policy Manual, Section 3.3. at the
same reimbursement rate. Sheriff anticipated some changes at the state level
that might have had an impact on the pricing and rates for this contract;
therefore, the Sheriff requested a one-year extension rather than a new
five-year contract. The one-year
extension allowed the Sheriff to perform a cost study once the State set its
new rates and pricing so appropriate rates could be negotiated for the
five-year contract. |

The proposed agreement is a sole
source agreement. The District is the only provider of state-approved
instructional programs that is willing to provide comprehensive adult education
services to all five County jails at no cost to the County.
Sheriff has verified that
there are no concerns that must be addressed with respect to contractor's
ownership/name, litigation status or conflicts with County interests. The
Orange County Preference Policy is not applicable to this agreement amendment.
Sheriff now requests Board approval
of Amendment Number One to the sole source agreement with the District and
increase for the provision of continuing education classes to inmates from
248,000 hours per fiscal year to 393,750 hours per fiscal year, effective upon
Board approval through the term ending June 30, 2026, as noted in the
recommended action. The District pays the County 50 cents per student
attendance hour, up to a maximum of 393,750 hours ($196,875) per fiscal year
for the use of County facilities and staff to provide classes to inmates at the
five County jail facilities. The
District approved this agreement at its October 23, 2023, Board meeting.
FINANCIAL
IMPACT:
The District provides services to
inmates at no cost to the County and will pay the County for the District's use
of County facilities and staff. Revenues
will be included in Sheriff-Coroner's FY 2023-24 Budget for Budget Control 144,
and will be included in the budgeting process for future years. Anticipated annual revenue by fiscal year is
noted in the following table.

This agreement contains language allowing
the Sheriff-Coroner Department to terminate the contract or reduce the level of
services without penalty with cause or without cause.
